Do you need a permit to replace a roof in Fayetteville — and how do you check a roofer?
Yes to the permit, and the checking takes one phone call. Both matter most in the two weeks after a hail day, when the trucks with out-of-state plates arrive.
The permit
The City of Fayetteville requires a building permit for roof-covering replacement. It's one of the most common permits the city's Development Services office issues, it's filed through the city's online permit portal, and it's how the city holds the work to the Arkansas Fire Prevention Code — the state's adoption of the International Residential Code. The code's roofing rules are short and sensible: no more than two layers of shingles (so a roof that's already been overlaid once has to be torn off), underlayment and drip edge as the manufacturer specifies, flashing at every wall, chimney and penetration, and shingles fastened to their wind rating. A repair that doesn't replace the roof covering — a pipe boot, flashing, a few shingles, a sheet of decking — generally doesn't need a permit.
Springdale, Rogers, Bentonville, Bella Vista, Farmington, Prairie Grove, Tontitown, Johnson, Elkins, Goshen, West Fork and Greenland each issue their own roofing permits through their building departments. The registration
Arkansas doesn't license residential roofers the way it licenses electricians — it registers them. Since January 1, 2022, any residential roofing contractor doing a job over $2,000 (labor and materials) has to be registered with the Arkansas Contractors Licensing Board and post a $15,000 surety bond. The bond is the point: if a roofer takes your deposit and disappears, does a bad job and won't fix it, or doesn't pay for the shingles and the supplier comes after you, you can claim against the bond much like an auto insurance claim. A roofer who also holds a Residential Building or Residential Remodeler license is covered by that instead.
Commercial work is separate: any project of $50,000 or more needs a commercial contractor's license from the same board, with experience and financial requirements a registration doesn't have. A roofer doing a $60,000 church roof on a residential registration is working illegally.
How to check a roofer in five minutes
- Call the Contractors Licensing Board at (501) 372-4661 (or search its online directory) with the company name. Confirm the registration is active and the bond is in force.
- Ask for a certificate of insurance naming general liability and workers' compensation for roofing. If a crew member falls off your roof and the company only has a handyman policy, you can be the one who pays.
- Ask for a local address and how long they've had it. Storm chasers rent a P.O. box after a hail day and give it up by fall.
- Ask who pulls the permit. The answer should be "we do, and it's on the invoice."
- Ask about the deductible. If they offer to waive it, cover it, rebate it or "handle it," that's insurance fraud and the conversation is over.
- Get the scope in writing — squares, shingle line, tear-off, decking price, underlayment, ice barrier, flashing, ventilation, disposal, permit, warranty. A number on a card isn't a quote.
